Copyright Policy

1. Ownership of Copyright

All photographs, video footage, edited images, creative direction materials (including mood boards, concept documents and style guides) produced by Brooked Studio (operated by Brooke Dixon, ABN: 29 885 071 960) are protected under the Copyright Act 1968 (Cth).

Copyright in all works created by Brooked Studio vests in and remains with Brooke Dixon from the moment of creation. Copyright does not transfer to any client, model, brand or third party upon payment or delivery of images.

2. Licence Granted to Clients

Upon receipt of full and final payment of all outstanding invoices, Brooked Studio grants the Client a non-exclusive, non-transferable licence to use the delivered images solely for the purposes agreed in the Client Service Agreement.

Standard licence usage includes:

  • Instagram and social media content (organic posts, Stories, Reels)

  • Website and e-commerce use

  • Email marketing and newsletters

  • Printed marketing materials (flyers, lookbooks, hang tags)

The following uses are NOT permitted without prior written consent from Brooked Studio:

  • Resale or commercial licensing of images to third parties

  • Use in paid advertising campaigns (Meta Ads, Google Ads, print advertising) — this requires a separate commercial licence agreement

  • Altering, cropping or manipulating images in a way that misrepresents the original work

  • Removing, obscuring or altering any watermark or credit applied by the Studio

  • Transferring or sublicencing images to any other individual or business

3. Credit and Attribution

Brooked Studio requests (but does not legally require) that clients credit @brookedstudio when sharing images on social media. This supports the Studio's growth and is appreciated as a condition of the working relationship.

4. Studio's Right to Use Images

Brooked Studio retains the right to use all images produced in the course of client engagements for the following purposes, unless the Client has requested otherwise in writing prior to the shoot:

  • Portfolio display on the Brooked Studio website

  • Instagram and social media content

  • Submissions to photography publications or competitions

  • Marketing and promotional materials for Brooked Studio

If the Client requires images to remain confidential (for example, due to a product embargo period), this must be communicated in writing prior to the shoot date and confirmed in the Client Service Agreement. A confidentiality period of up to 90 days may be agreed at no extra cost. Longer confidentiality periods may incur an additional fee.

5. Third Party Content

Brooked Studio will not incorporate third-party copyrighted material (including music, artwork, logos or trademarked imagery) into client deliverables without appropriate licences in place. The Client is responsible for ensuring that any branded products, artworks or trademarks included in a shoot have appropriate permissions for commercial photography use.

6. Infringement

Any use of Brooked Studio images beyond the scope of the agreed licence constitutes copyright infringement under the Copyright Act 1968 (Cth). Brooked Studio reserves the right to pursue all available legal remedies in the event of infringement, including seeking injunctions, damages and legal costs.
